Governor JB Pritzker Signs Comprehensive Law Regulating AI Algorithmic Worker Screening and Hiring Bias

SPRINGFIELD, IL — Governor JB Pritzker signed House Bill 3773 on Tuesday, establishing landmark statutory protections against algorithmic discrimination in hiring, promotion, and workforce evaluation across Illinois.

The measure positions Illinois as a national pioneer in regulating workplace artificial intelligence, following the state's precedent-setting Biometric Information Privacy Act (BIPA).

New Worker Rights in the Automated Economy Under the new statutory framework:

• Employers are explicitly prohibited from utilizing AI systems that have the effect of subjecting employees or applicants to discrimination on the basis of race, color, religion, sex, national origin, or disability.
• Companies must provide clear, accessible written disclosures to applicants prior to deploying AI tools that evaluate facial expressions, voice inflection, or predictive personality metrics during interviews.
• Employers cannot rely on AI models to make automated termination or disciplinary decisions without human oversight and documentation.

"In Illinois, we believe technology should empower workers and create opportunities, not erect invisible barriers of discrimination," Governor Pritzker stated at the James R. Thompson Center in Chicago. "As artificial intelligence reshapes corporate recruitment, this law ensures that qualified job seekers are judged on their skills and merits, not by biased algorithms."

Corporate Compliance and Legal Scrutiny Business organizations, including the Illinois Chamber of Commerce, raised concerns regarding implementation timelines, urging state regulators to provide clear auditing criteria before enforcement provisions take effect.

The Illinois Department of Human Rights announced that it will draft detailed administrative rules governing algorithmic auditing standards and publish compliance guides for small employers.
