WASHINGTON, DC — In one of the most significant federal industrial clean air regulations enacted in a generation, Environmental Protection Agency (EPA) Administrator Michael Regan finalized comprehensive Clean Air Act Section 112 National Emission Standards for Hazardous Air Pollutants (NESHAP) on Monday, establishing rigorous new fenceline pollution caps on more than 200 synthetic organic chemical manufacturing facilities nationwide.
The finalized rule, titled the Synthetic Organic Chemical Manufacturing Industry (SOCMI) Hazardous Air Pollutants Standards, mandates that chemical manufacturing plants slash toxic airborne emissions of cancer-causing chemicals—primarily ethylene oxide (EtO), chloroprene, benzene, 1,3-butadiene, and vinyl chloride—by more than 80% within three years. Public health epidemiologists estimate that the regulatory caps will dramatically reduce lifetime cancer risks for over 1.2 million residents living in fenceline communities along industrial corridors in Louisiana’s Cancer Alley, the Texas Gulf Coast, and the Ohio River Valley.
Under the new statutory framework, chemical plant operators must install continuous, automated optical fenceline air monitoring arrays along facility property boundaries. If fugitive toxic chemical concentrations exceed strict federal health action levels (such as 0.2 micrograms per cubic meter for ethylene oxide or 0.3 micrograms for chloroprene) at the property fenceline, plant operators are legally required to conduct immediate root-cause leak detection and repair malfunctioning storage tank valves, distillation seals, and wastewater flaring systems within 14 calendar days.
Furthermore, the rule eliminates longstanding regulatory loopholes that allowed chemical refineries to vent untreated toxic gases into neighboring residential communities during equipment startup, shutdown, and maintenance malfunctions without facing federal fines.
"Every single child in America, regardless of their zip code, has the fundamental right to breathe clean, healthy air free from toxic carcinogens," Administrator Regan stated during the signing ceremony. "These finalized Clean Air Act standards hold corporate polluters accountable, deploy cutting-edge continuous monitoring technology, and deliver overdue environmental justice and life-saving protections to communities that have carried the burden of industrial pollution for decades."
Environmental justice organizers and frontline community coalitions celebrated the finalized rule as a monumental victory for public health.
"For generations, families living in the shadow of petrochemical plants have suffered through devastating rates of rare cancers, asthma, and respiratory illness," said Sharon Lavigne, founder of RISE St. James in Louisiana. "Requiring real-time fenceline monitoring and ending the pollution loophole during plant malfunctions gives our communities the transparency, accountability, and clean air we have fought so hard to secure."
The American Chemistry Council (ACC) raised concerns regarding compliance timelines and engineering feasibility, cautioning that retrofitting hundreds of specialized industrial flaring systems and optical fenceline sensors will require substantial capital expenditures and could lead to temporary supply chain disruptions for essential medical sterilization chemicals.
The finalized SOCMI NESHAP standards take effect 60 days following publication in the Federal Register. Regulated chemical manufacturing facilities must complete fenceline monitor installation by October 2027, with mandatory quarterly public emissions reporting made accessible through an EPA online dashboard.
